Privacy Policy

This Privacy Policy explains what information Nightcap collects, how we use it, and the choices you have. It covers both venue operators who hold accounts and the guests who play games at those venues.

The short version. We collect what we need to run the Service: account and billing details from operators, and display names plus opt-in emails from guests who choose to give them. We use trusted processors (like Stripe for payments) and we don't sell your personal information. Game chat is stored to help us improve the games. This summary is for convenience only; the full policy below controls.

Nightcap ("Nightcap," the "Service") is operated by Right Click Forbidden LLC ("Company," "we," "us"). This policy applies to the playnightcap.com website, the operator dashboard, and the game experiences we provide. It does not cover the separate practices of the venues that use Nightcap, or of third-party sites we link to.

Nightcap uses automated and AI systems to host games — for example, to generate host dialogue and synthesize voice. Content shown during games (such as questions and host lines) may be processed by these systems. We use game content and aggregated engagement data, including game chat, to improve our games and the Service.

We keep information for as long as needed to provide the Service and for legitimate business or legal purposes. In particular:

We take reasonable technical and organizational measures to protect information — for example, encrypting traffic in transit, storing passwords in hashed form, and limiting access. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please help protect your account by using a strong, unique password and keeping it confidential.

12.U.S. state privacy rights

Depending on where you live, you may have rights under state privacy laws — such as the right to know what personal information we collect, to access or delete it, to correct it, and to not be discriminated against for exercising these rights. We do not sell personal information or use it for cross-context behavioral advertising. Residents of states that grant these rights (for example, California under the CCPA/CPRA, and residents of other states with comparable laws) may exercise them by contacting us at hello@playnightcap.com. We will respond as required by applicable law and will not discriminate against you for making a request.

13.Children's privacy

The Service is intended for businesses and adults and is not directed to children. We do not knowingly collect personal information from children under 13 (or under the age set by applicable law). Venues that use Nightcap are typically age-restricted environments. If you believe a child has provided us information, contact us at hello@playnightcap.com and we will take appropriate steps to delete it.

14.Do Not Track

Because there is no common industry standard for "Do Not Track" signals, we do not currently respond to them. We do not track our users across third-party websites for advertising.

15.Where we operate

The Service is operated from the United States and is intended for users in the United States. If you access it from elsewhere, you understand that your information will be processed in the United States, where privacy laws may differ from those in your location.

16.Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice as appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.
