1.Who we are & scope

Nightcap ("Nightcap," the "Service") is operated by Right Click Forbidden LLC ("Company," "we," "us"). This policy applies to the playnightcap.com website, the operator dashboard, and the game experiences we provide. It does not cover the separate practices of the venues that use Nightcap, or of third-party sites we link to.

2.Operators and players

Nightcap serves two kinds of people, and our role differs for each:

• Operators — the businesses and individuals who hold accounts, register venues, and run games. For operator information, we act as the business responsible for that data.
• Players (guests) — patrons who play games at a venue. Guests can play without an account. When a guest opts in to give an email address for a venue's prizes or offers, we collect that email on the venue's behalf and make it available to that venue. The venue is then independently responsible for how it uses that information (see our Terms of Service).

We use information to:

• Provide, operate, and maintain the Service and run game nights;
• Create and manage accounts, authenticate logins, and keep the Service secure;
• Process subscriptions, payments, trials, and renewals;
• Make opt-in guest emails and leaderboards available to the relevant venue;
• Analyze usage, engagement, and game chat to improve and develop the games and the Service;
• Respond to your requests and provide support;
• Send service and administrative messages (such as password resets, billing notices, and important updates);
• Detect, prevent, and address fraud, abuse, security issues, and technical problems;
• Comply with legal obligations and enforce our Terms.

5.Cookies & similar technologies

We use a small number of cookies and similar browser storage technologies, primarily to make the Service work rather than to track you across the web:

• Session cookie — keeps operators signed in to the dashboard.
• Local storage — used on players' devices for lightweight preferences, such as remembering that a guest has already been asked to share an email at a given venue so they aren't repeatedly prompted.

You can control cookies through your browser settings, but disabling them may affect how the Service works (for example, you may not be able to stay signed in).

6.How we share information

We do not sell your personal information. We share information only as follows:

• With the relevant venue — opt-in guest emails and leaderboard entries are made available to the venue for which they were collected.
• With service providers — trusted vendors that perform functions on our behalf under contract (see Section 7).
• For legal reasons — when we believe disclosure is required by law, legal process, or to protect the rights, safety, or property of the Company, our users, or the public.
• In a business transfer — in connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this policy.
• With your direction or consent — when you ask us to share information or otherwise agree to it.

7.Service providers

We rely on third-party providers to run the Service, including:

• Stripe — payment processing;
• Hosting infrastructure — to run our application and database;
• Email delivery — to send transactional messages such as password resets;
• Voice synthesis — to generate the host's spoken audio.

These providers may process information as needed to provide their services and are expected to protect it. Each operates under its own privacy practices.

8.AI processing

Nightcap uses automated and AI systems to host games — for example, to generate host dialogue and synthesize voice. Content shown during games (such as questions and host lines) may be processed by these systems. We use game content and aggregated engagement data, including game chat, to improve our games and the Service.

9.How long we keep information

We keep information for as long as needed to provide the Service and for legitimate business or legal purposes. In particular:

• Operator account and venue data — kept while your account is active and for a reasonable period afterward, unless you ask us to delete it sooner.
• Game chat — retained on a rolling basis (currently up to 365 days) and then automatically removed.
• Billing records — kept as needed to meet tax, accounting, and legal requirements.

We may retain de-identified or aggregated information, which cannot reasonably be used to identify you, indefinitely.

10.Security

We take reasonable technical and organizational measures to protect information — for example, encrypting traffic in transit, storing passwords in hashed form, and limiting access. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please help protect your account by using a strong, unique password and keeping it confidential.

11.Your choices & rights

• Access & correction — operators can view and update much of their account information from the dashboard, and can contact us for help with the rest.
• Deletion — you may ask us to delete your account information, subject to records we must keep by law.
• Marketing emails from venues — if a venue emails you after you opted in, you can unsubscribe using the link in that venue's email; that request goes to the venue, which is the sender.
• Guest email — sharing your email as a guest is always optional. You can decline and still play.

To make a request, email us at hello@playnightcap.com. We may need to verify your identity before acting on a request.

12.U.S. state privacy rights

Depending on where you live, you may have rights under state privacy laws — such as the right to know what personal information we collect, to access or delete it, to correct it, and to not be discriminated against for exercising these rights. We do not sell personal information or use it for cross-context behavioral advertising. Residents of states that grant these rights (for example, California under the CCPA/CPRA, and residents of other states with comparable laws) may exercise them by contacting us at hello@playnightcap.com. We will respond as required by applicable law and will not discriminate against you for making a request.

13.Children's privacy

The Service is intended for businesses and adults and is not directed to children. We do not knowingly collect personal information from children under 13 (or under the age set by applicable law). Venues that use Nightcap are typically age-restricted environments. If you believe a child has provided us information, contact us at hello@playnightcap.com and we will take appropriate steps to delete it.

14.Do Not Track

Because there is no common industry standard for "Do Not Track" signals, we do not currently respond to them. We do not track our users across third-party websites for advertising.

15.Where we operate

The Service is operated from the United States and is intended for users in the United States. If you access it from elsewhere, you understand that your information will be processed in the United States, where privacy laws may differ from those in your location.

16.Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice as appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.
